Refund Policy

1. Introduction

We strive to provide our clients with high-quality services for generating promotional materials, banners, logos, marketing texts, business content, AI chat assistance, and content processing using artificial intelligence. At the same time, we understand that there may be instances where technical issues prevent service usage. This refund policy defines the strict conditions and procedures for refunding unused additional energy and Prime status subscriptions.

2. Refund Conditions for Energy Points

A refund is possible ONLY in the following cases:

  • Critical technical issues that completely prevent the use of purchased energy for any generation attempts.
  • System errors resulting in energy point deduction without any generation attempt.

A refund is not possible in the following cases:

  • If the energy points were used for any generation attempts, regardless of the result.
  • If the user is not satisfied with the generated content (including banners, logos, promotional materials, marketing texts, AI chat messages, or any processing results).
  • If the generation process was completed but did not meet user expectations, business requirements, or quality standards.
  • If the generated materials are deemed unsuitable for commercial use or business purposes.
  • If the refund request is made later than 14 days from the date of purchase.
  • If the service was available but the user experienced connection issues on their side.
  • If the user is dissatisfied with the commercial effectiveness or business impact of generated materials.

3. Refund Conditions for Prime Status

Prime status subscriptions can be refunded ONLY in the following case:

  • If the service was completely unavailable for more than 50% of the active Prime subscription period due to technical issues on our side.

Prime status refunds are not available if:

  • The service was partially available during the subscription period.
  • The service was available but did not meet user expectations or business needs.
  • Content loss occurred due to any technical issues (as stated in Terms of Service).
  • The user was unable to access the service due to their internet connection or device issues.
  • The user no longer needs the Prime status features for their business.
  • The generated content did not meet business requirements or commercial standards.

4. Special Conditions for Generated Content

Due to the creative and subjective nature of AI-generated content:

  • Refunds are not available for any completed generations, regardless of the result, user satisfaction, or business suitability.
  • This includes but is not limited to: promotional banners, logos, marketing materials, business texts, chat responses, and content processing results.
  • Energy points used for failed generation attempts due to proven technical errors may be refunded only after thorough investigation.
  • Refunds are not provided based on subjective dissatisfaction with any aspect of the generated content, including commercial viability.
  • The artistic quality, commercial effectiveness, brand consistency, accuracy, or business usefulness of AI-generated content cannot be grounds for refund.
  • Refunds are not provided if generated materials do not meet professional design standards or business requirements.

5. Refund Request Process

To request a refund, the user must submit a formal written request following these steps:

  1. Download or prepare a written refund request document containing:
    • Full name as shown in payment details
    • Email address associated with the account
    • Date and amount of the purchase
    • Type of service (Energy points, Prime status, or Content generation)
    • Detailed reason for the refund request
    • Payment method used for the purchase
    • User's handwritten signature
    • Current date
  2. Sign the document by hand
  3. Scan or take a clear photo of the signed document
  4. Send the scanned document to support@promli.com

Important notes:

  • Refund requests without a signed document will not be processed
  • The signature must match the name provided in the request
  • Electronic or typed signatures are not accepted
  • The document must be clearly legible
  • Requests must be submitted in English or Russian language only

6. Request Processing

The refund request will be reviewed within 7 business days from the date of receipt. If the refund is approved, the funds will be credited to the user's account using the same payment method within 14 business days. Please note that not all refund requests will be approved, even with proper documentation.

7. Final Provisions

We reserve the right to change this refund policy at any time. Changes take effect from the moment they are published on our website. Users are notified of changes via email or a notification on the website.

  • Business text prompts are processed and stored only as necessary for service operation
  • Chat history with AI business assistants is stored to maintain conversation context
  • Generated promotional content is stored according to your account status (basic or Prime)
  • For basic accounts, generated content may be automatically deleted after a certain period
  • For Prime accounts, content is stored for the duration of the subscription period

5. Transfer of Personal Data to Third Parties

5.1. We do not transfer your personal data to third parties, except in the following cases:

  • When required by law
  • For payment processing through secure payment providers
  • For cloud storage services that help us store and protect your data
  • When such transfer is necessary to fulfill our contract with you

5.2. All third-party service providers we work with are bound by confidentiality agreements and data protection requirements.

Terms of Service

1. Introduction

This Terms of Service agreement (hereinafter referred to as "Agreement") governs the relationship between individual entrepreneur Ivan Vaskov (hereinafter referred to as "Service Owner") and users (hereinafter referred to as "User") of the AI-generated promotional materials, banners, logos, marketing content, and business texts service (hereinafter referred to as "Service").

2. Nature of the Service

2.1. The Service is an advanced generation tool, similar to a graphic design software or other creative instruments. It generates content based on User input and settings.

2.2. The User is responsible for conceiving ideas and adjusting generation parameters. The Service merely executes these instructions without any guarantee of quality, accuracy, or suitability for any purpose.

2.3. The Service does not provide any warranties regarding the creative value, commercial viability, or effectiveness of generated materials.

3. Rights to Content

3.1. The User retains all rights, including copyrights, to the generated banners, logos, marketing materials, and texts, provided that the content does not infringe on any third-party copyrights and does not violate any laws.

3.2. For all generated content, due to the use of AI algorithms and training data, the User is granted a non-exclusive license to use the generated materials for personal and commercial purposes.

3.3. The User has the right to use the generated content, including for commercial purposes, but assumes full responsibility for such use.

3.4. The Service does not guarantee the uniqueness of generated content and cannot ensure that similar content has not been or will not be generated for other users.

4. User Responsibilities

4.1. The User is solely responsible for ensuring that the content they create does not infringe on any third-party copyrights, violate any laws, or contain defamatory, discriminatory, or otherwise unlawful materials.

4.2. The User agrees not to use the Service to create content on political topics, promoting violence, containing offensive or sexual material, or any other inappropriate content.

4.3. The User agrees not to initiate any legal action against the Service or its owner related to the generated content, its quality, effectiveness, or any consequences of its use.

4.4. The User is solely responsible for backing up and storing their content. The Service strongly recommends downloading and storing all generated content on the User's own devices or storage solutions.

4.5. The User is fully responsible for verifying that generated content is suitable for their intended business purposes and complies with all applicable advertising regulations and standards.

4.6. The User assumes all risks associated with using AI-generated content for business purposes and agrees to indemnify the Service Owner against any claims arising from such use.

5. Limitation of Liability

5.1. The Service does not guarantee the uniqueness, quality, effectiveness, or commercial viability of the generated content and is not responsible for any potential claims from third parties.

5.2. The Service Owner is not liable for any damages, including but not limited to lost profits, business losses, reputational damage, or any other losses incurred by the User or any third party as a result of using the Service or the generated content.

5.3. The User agrees that the use of the Service is at their own risk. The Service Owner is not liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Service.

5.4. The Service Owner is not responsible for any data loss, regardless of cause, including but not limited to technical failures, system updates, or service maintenance. Users should maintain their own backups of important content.

5.5. The Service provides no warranty that generated content will be suitable for any particular business purpose, marketing campaign, or commercial use.

5.6. The Service Owner disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

6. Content Restrictions and User Responsibility

6.1. Users have the ability to create and download promotional materials. The User bears full responsibility for the use of materials. The User must verify that the generated content (or any business use thereof) does not violate laws, third-party copyrights, advertising regulations, or the Service's usage rules.

6.2. The Service reserves the right to refuse generation or block access to content at its discretion without prior notice in case of violation of usage rules or upon receiving complaints from third parties.

6.3. The User is solely responsible for ensuring that any business use of generated materials complies with all applicable laws, regulations, and industry standards.

7. Changes to the Agreement

7.1. The Service Owner reserves the right to change this Agreement at any time. Changes take effect from the moment they are published on the Service's website.

7.2. The User agrees to regularly review the terms of this Agreement for any changes.

8. Final Provisions

8.1. Use of the Service implies the User's acceptance of the terms of this Agreement.

9. Content Usage and Rights

9.1. By using the Service, the User agrees that any content created with the help of the Service or uploaded to the Service may be used for training artificial intelligence models and for the Service's internal purposes, such as improving algorithms, testing, etc.

9.2. The User must possess all necessary rights to any content they upload to the Service, including but not limited to images for promotional material generation, text for marketing content creation, brand elements for logo design, or any other input material.

9.3. The User assumes full responsibility for any content they upload or input into the Service. In the event of any claims, disputes, or legal issues arising from the User's content or its commercial use, the User agrees to indemnify and hold harmless the Service Owner from any liability, damages, or losses incurred as a result of such claims. The Service Owner shall not be responsible for any content uploaded by Users or any business consequences of using generated materials, and the User shall be solely responsible for resolving any claims or disputes related to their content or its commercial application, including but not limited to copyright infringement claims, trademark disputes, false advertising claims, defamation claims, or any other legal issues. The User further agrees to compensate the Service Owner for any costs, expenses, or losses incurred as a result of claims or legal actions brought by third parties in connection with the User's content or its business use.

10. Dispute Resolution

10.1. Any disputes arising in connection with this Agreement shall be resolved through negotiations whenever possible.

10.2. If no agreement is reached, the dispute shall be referred to the court located at the Service Owner's registered address and resolved in accordance with the laws of the Russian Federation.

11. Prime Status and Content Storage

11.1. Prime status is a premium subscription that provides additional features, including extended content storage.

11.2. While Prime status allows for extended storage of generated content, the Service Owner does not guarantee permanent storage or preservation of any content. Technical issues, system failures, or other circumstances may result in content loss.

11.3. The Service Owner reserves the right to modify, limit, or discontinue Prime status features at any time.

11.4. Users are responsible for maintaining their own backups of important content, regardless of their subscription status.

12. AI Content Generation

12.1. The promotional material generation feature creates content based on user-provided prompts and requirements. The Service does not guarantee any specific level of quality, commercial effectiveness, brand consistency, or aesthetic value of the generated materials.

12.2. Users must have full rights to use and upload any images, brand elements, or other materials submitted for content generation.

12.3. The Service Owner is not responsible for any dissatisfaction with the generated materials, business losses resulting from their use, or any claims regarding quality, effectiveness, brand appropriateness, or commercial merit.

12.4. Generated materials are provided "as is" without any warranties or guarantees of any kind, including fitness for commercial use.

12.5. The User acknowledges that AI-generated content may not always meet professional design standards or business requirements and agrees to verify suitability before any commercial use.
